All but the smallest public sector procurements in most of Western Europe must take place within a very particular legal framework. 1 For software solution procurement this traditionally meant putting out for competitive tender both the software and related adaption and implementation work in one often big package.
With the advent of open source software, public buyers now have a second choice. We will look into how the billions of euros spent on information technology (IT) by the European public sector each year may be spent differently, and which implications the arrival of open source has for contracts in the public sector.
