1. How do you apply for protection abroad?

A Norwegian design application can be pursued abroad within six months of the application date.  Design applications must be submitted to all of the countries in which you want your product protected.

2. How long does a design registration last?

A design registration is valid for one or more five-year periods. A period begins when the application is submitted. You may renew your registration for several periods up to a maximum of 25 years.

3. Can a registration be reviewed?

If someone believes design protection has been granted incorrectly, he can ask the Patent Office at any time to undertake an administrative review of the design's registration.

Registration can be declared invalid as a result.

4. What happens when design protection expires?

When protection expires, a design may be used by any person. 

Occasionally, the right of others to use a design may be limited by certain legislation, e.g.:

  • the Marketing Act (it is contrary to good business practices to use a design which is very similar to a competitor's)
  • the Copyright Act (copyright protection)

5. How do you apply for protection abroad?

A Norwegian design application can be pursued abroad within six months of the application date.  A design application can be submitted to all of the countries in which you wish your product protected; otherwise, you can apply for an EU design or use the Geneva agreement.
